JTPCK Terms of Service

Last Updated: January 14th, 2026 These Terms and Conditions govern access to and use of JTPCK (the “Service”), operated by Jesse Waites, doing business as BCKPCKR (“BCKPCKR,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. 1. Eligibility You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. The Service is offered globally. You are responsible for ensuring your use of the Service complies with all applicable local laws and regulations. 2. Description of the Service JTPCK is a telemetry aggregation and visualization service that allows users to send, store, process, and view telemetry data generated by AI-assisted coding tools, including but not limited to Claude Code, OpenAI Codex, and Google Gemini CLI, via the OpenTelemetry standard. The Service exists solely to provide observability, analytics, and insights derived from user-submitted telemetry data. 3. Account Registration To use the Service, you must create an account. You agree to: Provide accurate and complete information Maintain the security of your account credentials Accept responsibility for all activity occurring under your account You must notify us immediately of any unauthorized access or security breach. We are not responsible for losses caused by unauthorized account access resulting from your failure to safeguard credentials. 4. Data Collection and Use 4.1 Data Collected The Service collects telemetry data that you explicitly configure your tools to send, which may include: Request and response metadata Token counts Model identifiers Latency and performance metrics Application or tool identifiers Logs, traces, and metrics emitted via OpenTelemetry Potentially user-generated code snippets or prompts if included in telemetry payloads 4.2 Purpose of Collection All data is collected and processed solely to provide and operate the Service, including: Displaying dashboards and analytics Aggregating usage metrics Improving reliability and performance Debugging and operational monitoring We do not sell telemetry data. 4.3 Infrastructure and Storage Data is stored and processed on servers hosted by Hetzner Online GmbH. By using the Service, you acknowledge that your data may be processed in jurisdictions different from your own. 5. User Responsibilities and Acceptable Use You agree not to: Use the Service for unlawful purposes Submit telemetry that infringes intellectual property rights Transmit malware, exploits, or malicious payloads Attempt to reverse engineer, disrupt, or compromise the Service Use the Service to monitor individuals without authorization You are solely responsible for the content and legality of the data you send. 6. Intellectual Property All rights, title, and interest in the Service, including software, interfaces, branding, and documentation, are owned by Jesse Waites and BCKPCKR. You retain ownership of your submitted data. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and display your data for the purpose of operating the Service. 7. Free Service and Future Changes The Service is currently provided free of charge. We reserve the right to: Introduce paid plans or features in the future Modify or discontinue free features Impose usage limits If paid features are introduced, they will be governed by additional terms presented at that time. 8. Termination We may suspend or terminate your account at any time, with or without notice, if: You violate these Terms Your use poses a security or legal risk The Service is discontinued You may terminate your account at any time. Upon termination, access to your data may be removed or deleted at our discretion. 9. Disclaimer of Warranties THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING: MERCHANTABILITY FITNESS FOR A PARTICULAR PURPOSE NON-INFRINGEMENT AVAILABILITY ACCURACY OR COMPLETENESS OF DATA We do not warrant that the Service will be uninterrupted, error-free, or secure. 10. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JESSE WAITES OR BCKPCKR BE LIABLE FOR: INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS DAMAGES ARISING FROM DATA LOSS OR MISCONFIGURED TELEMETRY OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED USD $100, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 11. Indemnification You agree to indemnify and hold harmless Jesse Waites and BCKPCKR from any claims, damages, losses, or expenses arising out of: Your use of the Service Your submitted data Your violation of these Terms Your violation of any law or third-party rights 12. Arbitration and Dispute Resolution Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, not in court, except where prohibited by law. Arbitration shall be conducted: On an individual basis only Under the rules of the American Arbitration Association In the United States In English You waive any right to participate in class actions or class arbitrations. 13. Governing Law These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. 14. Changes to These Terms We may update these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. 15.
